Important Amendments Effective October 1, 2017
There are a number of new provisions for licensees providing brokerage services. Here are some highlights:
- During an Open House, if the Seller consents in writing, their Listing Agent may discuss other properties with Prospective Buyers or Lessees that attend the Open House.
- Unless the Brokerage Agreement states otherwise, a Listing Agent is not required to seek additional offers to purchase or lease real estate while the property is subject to an existing sales contract or lease.
- Disclosure of confidential information about a client to any other party, licensee, or representative of another party, requires the client’s written consent.
There were changes to the law regarding homeowner associations, notices to HOA's and Condo Associations regarding foreclosures, and changes to the foreclosure filing requirements take effect October 1, 2018. Find out all the details on the FCAR Blog...

Recap of Commercial Lunch & Learn
Kelly Schulz, Maryland DLLR Secretary, was the special guest speaker at the November 8, 2017 Commercial Seminar attended by 30+ members. She noted that over 130,000 jobs have been created during the first three years of the Hogan Administration and that the unemployment rate has dropped to 3.7%. Schulz said that there are 20,000 IT/Cyber-security job vacancies in Maryland that are still unfilled and mentioned a great website by MD Department of Commerce on the subject at: https://open.maryland.gov/it-and-cybersecurity/. Another great site for job seekers that she referenced is: https://mwejobs.maryland.gov/vosnet/Default.aspx?plang=E.
Bill Castelli, Senior VP of Governmental Affairs for Maryland REALTORS®, discussed the implications of potential federal Tax Reform on commercial real estate and noted that 1031 Exchanges are still in the bill, but apply only to real property. Other problematic tax changes that would adversely impact real estate have resulted in NAR’s opposition to the bill. Castelli mentioned many state-level issues related to solar facilities, septic systems, sustainable growth, foreclosures, paid sick leave and forest mitigation, that will likely be revisited during the next Legislative session that could adversely impact commercial real estate in Maryland.
